Aranea's Adopts

Terms of Service

If you request, order, purchase or acquire art or other works from me, the artist (Aranea, Aranea's Adopts, Mirai, MirPuzzle), it means you, the client, have read, understood, and agreed to the following terms.

Sections

General

• I retain the rights to my works. You may not claim my works as your own creation.
• You may not repurpose my works or use them in a way they're not intended, or for illegal or malicious activities in real life (fiction doesn't count), Generative AI, AI-training, Block-chain technology, NFTs, or any similar technology invented in the future.
• I will not be held responsible for any use that you or other people make of my works.
• You may not edit or trace over my WIPs or works (with the exception of Assets that I offer to you), or copy/heavy reference them (except for Adoptables you currently own).
• I reserve the right to reject any adoption, commission, or other request for any reason.
• I may display my works on my platforms, websites, social media or portfolio for promotion and showcase purposes (although this can be discussed for each individual Commission). I do not claim rights to characters I haven't created.
• Some generic or themed decorative elements that are present in my works (such as backgrounds, borders, patterns or frames) or character poses may not be exclusive to that work, and I may reuse or adapt them to other works (such as offering a frame I first featured in an Adoptable's extra art in YCH Commissions).
• You understand that my products are digital files and they don't require shipping.

Adoptables

Also called Adopts. They're designs (usually characters) created to be handed to other people who will then make use of them (commonly as OCs).

Ownership and uses

• You recognize me as the Adoptable's creator. As the creator, I hold the rights to the Adoptable's design and their original files.
• After you've successfully purchased or acquired an Adopt from me, I've received your payment for the Adopt (if applicable), and you've received the Adopt's file(s), you become the Adopt's owner, and there is no refund (if applicable). As the Adoptable's owner, you are allowed to use the character however you wish as long as these Terms allow it.
• You are allowed to make any changes you wish in your owned Adopt's design, give them a name, gender, story, draw them, etc.
• Personal use: allowed for the Adoptable's design and the original files. This includes personal merchandise, although some of our Adopts' files may not be fit for this.
• Commercial use: Streaming, promotional content, commercial comics, games, videos and similar use is allowed for the Adoptable's design and the original files.
• Commercial merchandise: Physical or digital commercial end products are allowed for the Adoptable's design, but not for the original files. If you wish to sell merch of your owned Adoptable, you may draw them yourself or commission someone to design merch for you.
• The original files of the Adoptable, be it art or not, as well as their original design, can only be associated with that Adoptable (example: if an Adoptable comes with an original music theme, that theme can only be used for that Adoptable, or in projects related to that Adoptable).
• If there is a problem with the payment after purchasing the Adoptable, or if you acquired the Adoptable in a dishonest way (like cheating in a contest I hosted with the Adopt as a prize), I may revoke your ownership of the Adoptable and put them back up for sale. I won't revoke your ownership of any Adoptable that you've successfully paid for (as long as it remains paid).

Transferring an Adoptable

Transferring refers to the act of giving an Adoptable you own to someone else.

• You understand that an Adoptable can only have one (1) owner at any given time. You cannot transfer the same Adoptable to more than one person.
• For Adopts you've purchased, you may trade, give them away, gift or resell them (for no more than the amount you paid, unless they come with extra art that you've commissioned).
• For Adopts you have acquired without paying (via trade, gift, raffle, giveaway, etc.), you may trade, gift or give them away, but you aren't allowed to sell them.
• If you transfer your owned Adopt to another person, in which case that person becomes the Adopt's owner (and you're no longer the Adopt's owner), you must give the new owner at least the original files you got of the Adopt. The new owner must know that the Adopt was designed by us, and they must agree to these terms. Please understand that I cannot mediate between you and the new owner if a problem arises between you two.

Commissions

Commissions include YCH Commissions and Custom Adopts.

• We'll only start working on a commission after we've received the payment.
• WIPs may be heavely-watermarked.
• We will not draw in another artist's style.

Custom Adoptables

• When you purchase a Custom Adoptable from us, you agree to receive one or more digital file(s) of a newly-designed character that can range from random to partially customized.
• Due to the nature of Gacha/Custom Adopts being a surprise character design, WIPs will not be provided.
• You agree to follow the instructions indicated in the Custom Adoptable Commission. Customization and total price will depend on the Add-ons you purchase with the Commission.
• If you purchase one or more Add-ons for the Custom Adoptable, please give us a clear description of what you'd like, according to said Add-ons. Changes to the finished Custom Adoptable design and file(s) will only be made if we made a mistake following your description. We will not edit the final design or files to change something that wasn't originally in your description.

YCH Commissions

• YCH Commissions will be handled via VGen at vgen.co/Aranea.
• Details pertaining to the Commission should be communicated and discussed through VGen.
• You may not use our commissions, WIPS or drafts to commission someone/something else, or to have someone/something else (including yourself) finish the commission.

Assets / Resources

Assets are the subgroup of my works that help you design your own works, also known as Resources. This includes Character Bases, Brushes, Backgrounds, etc.

• You may edit my Asset as you see fit as long as it's for your own use.
• You may not share or sell my Asset (nor any part of it) as-is.
• You may only create digital and physical end products with my Asset. You may not use or repurpose my Asset to create derivative assets/resources to share with or sell to others.
• You may not use my Asset for YCH or other commissions (with the exception of your custom adoptable/character design commissions).
• Personal use: allowed for personal digital art, personal merchandising, gifts, art trades.
• Commercial use: allowed for premade and custom adoptables/character designs, premade digital art, premade physical merch, raffles/giveaways, premade promotional content, streaming, contest entries (as long as the contest's host allows it).*

*With "premade" I mean non-commissioned or non-customized works that have been created without any input from a client.

Illustrations

Illustrations are premade art I sell or offer.

• Only Illustrations that I specifically sell or offer through my shops are meant to be used in this way. You may not use my regular art.
• My Illustrations are for personal use only. You may not share or sell my Illustration (nor any part of it) in any way.
• You may use my Illustration as your phone/computer background, personal social media profile picture or header (with credit).
• You may make personal merch of my Illustration (for yourself only).
